TERMS OF SERVICE - STUPID HARD CHESS

These Terms of Service ("Terms") govern your use of the Stupid Hard Chess

iOS application ("the app"), published by Yazeed Masri, an individual

developer ("I," "me," "the developer"). By downloading, accessing, or using

the app, you agree to these Terms. If you do not agree, do not use the app.

1. THE SERVICE

Stupid Hard Chess is a single-player chess game played against a computer

engine, with a twist: pieces you choose to hide are rendered as identical,

same-appearance markers, and you must track what they are from memory. The

app offers a free, ad-supported tier and an optional paid "Pro"

subscription (section 4). The app is available for iOS only, through the

Apple App Store.

2. YOUR ACCOUNT

- Using the app requires signing in with Apple or Google. You must provide

accurate account information and keep access to your sign-in method.

- Your account is personal to you. You are responsible for activity that

occurs under it.

- You may delete your account at any time in the app (Profile > Delete

Account). Deletion permanently removes your account and its backend data,

including your Stupid Score and Stupid Streak, which cannot be restored.

- I may suspend or terminate accounts that violate these Terms

(section 10).

3. ACCEPTABLE USE

You agree not to:

- use the app for any unlawful purpose;

- interfere with or disrupt the app or the servers and services it relies

on;

- attempt to gain unauthorized access to other users' accounts or to

systems used by the app;

- reverse engineer, decompile, or disassemble the app except where such a

restriction is prohibited by law;

- resell, redistribute, or commercially exploit the app or its content.

4. PRO SUBSCRIPTION, BILLING, AND FREE TRIAL

Plans. Pro is an auto-renewing subscription offered as a monthly plan

($4.99/month) and an annual plan ($39.99/year). The price shown in the App

Store at the time of purchase is the price that applies; prices may vary by

region and may change for future billing periods with notice through the

App Store.

What Pro includes. No ads, additional per-game board reveals, the full

Customize mode, and advanced statistics, as described in the app.

Billing by Apple. All payment, billing, renewal, cancellation, and refund

processing is handled by Apple through your Apple account, not by me. I

have no access to your payment details and cannot issue refunds; refund

requests go to Apple (reportaproblem.apple.com).

Free trial. New subscribers receive a 7-day free trial. Trial eligibility

is determined by the App Store (one trial per subscription group; if you

previously subscribed and lapsed, you may not be eligible again). Unless

you cancel at least 24 hours before the trial ends, the subscription begins

and your Apple account is charged.

Auto-renewal. Subscriptions renew automatically at the end of each billing

period unless cancelled at least 24 hours before the period ends. You can

manage or cancel your subscription anytime in your Apple account settings

(Settings > Apple ID > Subscriptions).

Lapse. If your subscription ends, Pro features lock and the free tier

resumes, including ads. Your Stupid Score and Stupid Streak are preserved.

Conditions (https://www.apple.com/legal/internet-services/itunes/).

5. SCORES, STREAKS, AND VIRTUAL FEATURES

Stupid Score, Stupid Streak, board reveals, and similar in-app features are

gameplay features only. They have no monetary value, cannot be sold,

transferred, or redeemed, and may be adjusted, rebalanced, or reset as part

of updates to the game's design.

6. INTELLECTUAL PROPERTY

Except for the third-party components described below, the app, including

its code, design, artwork, name, logo, and content, is the property of the

developer and is protected by applicable intellectual property law. You

are granted a limited, personal, non-exclusive, non-transferable,

revocable license to use the app for your own non-commercial entertainment

on Apple-branded devices that you own or control, in accordance with these

Terms and the App Store's usage rules. No other rights are granted.

Third-party and open-source components. The app incorporates third-party

software components that are not owned by the developer and are licensed

under their own terms, including the Stockfish chess engine, (c) the

Stockfish developers, licensed under the GNU General Public License

version 3 (GPLv3; https://www.gnu.org/licenses/gpl-3.0.html; source at

https://github.com/official-stockfish/Stockfish). Nothing in these Terms

limits or removes any rights those licenses grant you, and to the extent

of any conflict between these Terms and an open-source license, the

open-source license governs for the component it covers.

7. THIRD-PARTY SERVICES

The app relies on third-party services, including Apple (sign-in,

distribution, payments), Google (sign-in, advertising), Supabase (backend),

PostHog (analytics), and Sentry (crash reporting). Your use of those

services is subject to their own terms and privacy policies. How the app

uses data through these services is described in the Privacy Policy. The

app also incorporates third-party open-source software, including the

Stockfish chess engine (see section 6).

8. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY

KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF

MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. I

DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA

(INCLUDING SCORES AND STREAKS) WILL NEVER BE LOST. SOME JURISDICTIONS DO

NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT

APPLY TO YOU.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE

FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES,

OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO

YOUR USE OF THE APP. THE DEVELOPER'S TOTAL AGGREGATE LIABILITY FOR ANY

CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED

THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12)

MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS ($50). SOME

JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE

ABOVE MAY NOT APPLY TO YOU.

10. TERMINATION

You may stop using the app, and may delete your account in the app, at any

time. I may suspend or terminate your access to the app if you materially

violate these Terms. Sections 5 through 9 and 11 through 13 survive

termination.

11. APPLE APP STORE TERMS

These Terms are between you and the developer only, not with Apple. Apple

is not responsible for the app or its content, and has no obligation to

provide maintenance or support for it. To the extent required by Apple's

terms: Apple and Apple's subsidiaries are third-party beneficiaries of

these Terms and may enforce them against you; and in the event the app

fails to conform to an applicable warranty, you may notify Apple for a

refund of the purchase price (if any), and to the maximum extent permitted

by law Apple has no other warranty obligation with respect to the app.

12. GOVERNING LAW

These Terms are governed by the laws of the Commonwealth of Massachusetts,

USA, without regard to conflict-of-law principles. Any dispute arising out

of or relating to these Terms or the app shall be brought in the state or

federal courts located in Massachusetts, and you consent to their

jurisdiction.

13. CHANGES TO THESE TERMS

I may update these Terms from time to time. The effective date above will

be revised, and material changes will be noted in the app or its App Store

release notes. Continued use of the app after a change means you accept the

updated Terms.
